Glenn ORDINANCE NO. 9413 AN ORDINANCE CLOSING AND ABANDONING A PORTION OF EAST 18TH STREET LOCATED SOUTHEAST FROM ADAMS STREET, NORTHEAST OF ROSSVILLE AVENUE, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned a portion of East 18th Street located southeast from Adams Street, northeast of Rossville Avenue, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: East 18th Street, a right-of-way some 13 feet wide beginning on the southeast line of Adams Street some 178 feet northeast of the intersection of the southeast line of Adams Street with the northeast line of Rossville Avenue, thence northeast 13 feet with Adams Street, thence southeast some 254 feet to the southeast line of Lot 37, Block 6, Montagues Addition No. 1, as shown by plat of record in Plat Book 2, Page 34, R.O.H.C., thence southwest some 13 feet with said lot line, and said line extended, to the southwest line of East 18th Street, thence northwest some 254 feet with East 18th Street to the southeast line of Adams Street, the point of beginning. Said street separates Lots 27, 29, 31, 33, 35, and 37, Block 6, said Montagues Addition No. 1, from Lots 2, 3, and 4, and Part of Lots 1 and 6, Cotters Subdivision, as shown by plat of record in Deed Book M, Volume 2, Page 676, R.O.H.C. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within the right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved as an easement for the operation, maintenance, rebuilding and replacement of these distribution facilities. 2. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 3. The areas reserved for utility easements must be kept free and clear of all structures. 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
